1. About Clearform

Clearform is a response-first form and feedback platform designed to help organizations collect structured, decision-ready feedback and insights. Clearform is operated by Unisync Infosystems Private Limited, incorporated in India.

2. Eligibility

You must:

• Be at least 18 years old
• Have authority to enter into a binding agreement on behalf of your organization (if applicable)
• Comply with all applicable laws and regulations

3. Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate information
• Keep your login credentials secure
• Notify us of unauthorized use
• Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of the Service

You agree not to:

• Use the Service for unlawful purposes
• Collect or process personal data without proper consent
• Upload harmful, abusive, or illegal content
• Attempt to reverse-engineer, disrupt, or exploit the platform
• Bypass usage limits or security controls

You are solely responsible for the content you create and distribute through Clearform.

5. Customer Data

• Ownership: You retain ownership of all content and data submitted through your forms ("Customer Data"). Clearform does not claim ownership of your Customer Data.
• License to Operate: You grant Clearform a limited, non-exclusive license to process and store Customer Data solely for the purpose of providing the Service.
• Responsibility: You are responsible for ensuring you have lawful grounds to collect data, providing required privacy notices to respondents, and complying with applicable data protection laws (including the Indian IT Act and GDPR where applicable).

6. Data Protection & Privacy

Clearform processes data in accordance with its Privacy Policy. We implement reasonable technical and organizational measures to protect data against unauthorized access, loss, or misuse. However, no system can be guaranteed 100% secure.

7. Beta Services

Certain features may be marked as "Beta." Beta features may change without notice, may contain bugs or limitations, and are provided "as is". We are not liable for damages arising from beta features.

8. Integrations & Third-Party Services

Clearform may integrate with third-party services (e.g., Google Sheets, Slack, WhatsApp providers). We are not responsible for:

• Third-party service availability
• Data handling by third parties
• Changes in third-party APIs or policies

Your use of third-party services is subject to their terms.

9. Fees & Payment

If you subscribe to a paid plan:

• Fees are billed in advance
• Payments are non-refundable unless required by law
• Failure to pay may result in suspension

We reserve the right to change pricing with reasonable notice.

10. Intellectual Property

All rights, title, and interest in the Clearform platform, software, branding, and materials remain the property of Clearform. You may not copy, modify, resell, license, or distribute any part of the Service without written permission.

11. Termination

We may suspend or terminate your account if you violate these Terms, misuse the platform, or as required by law. You may stop using the Service at any time. Upon termination, access to your data may be limited after a reasonable period.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available." Clearform does not guarantee error-free operation, continuous availability, or specific decision outcomes. You use the Service at your own risk.

13. Limitation of Liability

To the maximum extent permitted by law, Clearform shall not be liable for indirect or consequential damages, loss of profits, loss of data, or business interruption. Our total liability shall not exceed the amount paid by you in the preceding 12 months.

14. Indemnification

You agree to indemnify and hold harmless Clearform from claims arising out of your misuse of the Service, your violation of laws, or your collection or processing of data.

15. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the jurisdiction of courts located in Hyderabad, Telangana, India.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after updates constitutes acceptance.
